The Care Alarm Company – Lease and Monitoring Service Agreement

1. Medical Alarm System Lease Terms: The COMPANY leases and provides instructions for the proper use of the Medical Alarm System (referred to as “System” or “equipment”). The System, including all devices and equipment, remains the personal property of the COMPANY and is provided to the Subscriber for the duration of this agreement.
2. Commencement of Medical Alarm Monitoring Services: Monitoring services will begin upon the Subscriber’s receipt of the equipment. This Agreement encompasses additional documents to be signed and returned by the Subscriber, including MedGuard’s Financial Form and Subscriber Information and Responder Form.
3. Cancellation Policy: The Subscriber may cancel this agreement with 30 days notice and must return the equipment upon contract expiration. Cancellation terms are subject to statutory regulations which may vary by state.
4. Charges and Renewal: The Subscriber agrees to pay the COMPANY as outlined in the MedGuard Financial Form. This contract automatically renews monthly after the initial term unless cancelled by either party with written notice. Charges for unreturned or damaged equipment may apply.
5. Term and Renewal Conditions: This agreement renews monthly unless a 30-day prior written notice is given by either party. Non-return of equipment will incur charges.
6. Price Adjustments: The COMPANY will not increase charges during the term of this agreement. Post-agreement, rates and charges are subject to change.
7. Central Office Monitoring: The COMPANY will make reasonable efforts to notify appropriate emergency services upon signal receipt. The COMPANY is not responsible for transmission failures or equipment issues beyond its control.
8. Subscriber’s Responsibility for Equipment: The Subscriber must not tamper with the System and is responsible for costs arising from damage beyond ordinary wear and tear.
9. Telephone Service Requirement: The System requires a standard telephone service, which is the Subscriber’s responsibility to maintain.
10. Electrical and Telephone Service Provision: The Subscriber is responsible for providing necessary electrical and telephone connections.
11. Installation Delays: The COMPANY is not liable for delays in installation or service interruptions.
12. System Testing and Service: The Subscriber is responsible for testing the System and notifying the COMPANY of any required repairs.
13. Insurance of Equipment: The Subscriber shall insure the COMPANY’s equipment against damage or loss.
14. Emergency Procedures: The System includes two-way voice communication. In emergencies where communication is unclear, the COMPANY may initiate emergency procedures, including authorizing forcible entry if necessary.
